Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the WebCallHub service, the WebCallHub websites at webcallhub.in and webcallhub.com, the WebCallHub WordPress plugin, and any related APIs, widgets, and applications (collectively, the “Service”).
The Service is operated by HSG IT Services Oy (Finland) and HSG IT USA LLC (Austin, Texas, USA) (together, “we”, “us”, “WebCallHub”). By using the Service, you (“you”, “Customer”) agree to these Terms. If you do not agree, do not use the Service.
1. The Service
WebCallHub provides a browser-based click-to-call widget that lets visitors on your website connect to your team via WebRTC audio calls, plus an optional 24/7 AI receptionist. The Service includes the hosted widget runtime, signalling infrastructure, optional transcription and AI voice-agent features, the administrator dashboard, and the WordPress plugin.
2. Account and Eligibility
- You must be at least 18 years old and legally capable of entering into a contract.
- You are responsible for the accuracy of registration information and for keeping your credentials secure.
- You are responsible for all activity under your account, including actions by your agents and end users.
3. Plans, Trials, and Billing (India)
- Free trials are offered for 14 days and do not require a credit card. A free-forever plan is also available.
- Indian customers are billed in Indian Rupees (INR) at the prices listed on webcallhub.in — Starter ₹599, Growth ₹1,499, Business ₹3,999 per month, with annual options. Enterprise is custom-quoted.
- You receive an invoice for every payment. Any indirect taxes that may become applicable will be added only as and when required by law, and shown separately on the invoice.
- Paid plans are billed monthly or annually in advance and renew automatically until cancelled. Prices may change with 30 days’ notice for existing subscribers.
- For paid plans, payment is currently collected by UPI: contact us and we will share a UPI QR code; once payment is confirmed we activate your plan and assist with installation. You receive an invoice for every payment. Card-based self-checkout may be offered in future. Fees are non-refundable except where required by applicable law.
- You may cancel at any time from your dashboard. Cancellation stops future billing; previously paid fees are not refunded on a pro-rata basis.
4. Acceptable Use
You agree not to use the Service to:
- Make unsolicited, fraudulent, harassing, or illegal calls, or to violate TRAI / DND and unsolicited-commercial-communication regulations.
- Record or transcribe calls without obtaining any legally required consent from visitors — you are responsible for consent under the DPDP Act 2023 and other applicable law.
- Transmit malware, probe, scan, or disrupt the Service, or circumvent usage limits.
- Reverse-engineer, resell, or white-label the Service without written authorisation.
- Violate third-party rights or any applicable law.
5. WordPress Plugin
The WebCallHub WordPress plugin is distributed under the GPL-2.0-or-later license. The plugin is free; it loads the WebCallHub widget from our servers, which requires an active account. See the Privacy Policy for the data it transmits.
6. Your Content and Your Visitors
- You retain ownership of content you submit (account data, call recordings, transcripts, etc.).
- You grant WebCallHub a limited, worldwide license to host, transmit, process, and display that content solely to operate and improve the Service for you.
- You are the Data Fiduciary for information about your website visitors; WebCallHub acts as Data Processor. A Data Processing Addendum is available on request.
7. Intellectual Property
The Service, including all software, designs, logos, and documentation (excluding the GPL-licensed WordPress plugin source), is owned by WebCallHub and protected by applicable law. We grant you a non-exclusive, non-transferable right to use the Service during your subscription.
8. Third-Party Services
The Service may integrate with third-party providers (e.g., TURN/STUN relays, speech-to-text APIs, email delivery, payment processors). Your use of those integrations is also subject to the providers’ own terms.
9. Availability and Support
We target high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced when practical. Support is provided via email at [email protected].
10. Termination
You may terminate your account at any time. We may suspend or terminate access immediately if you breach these Terms, engage in prohibited activity, or place the Service or other users at risk. On termination, your data may be deleted after a reasonable retention period (see the Privacy Policy).
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBCALLHUB’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 100 (or its INR equivalent). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA.
13. Indemnification
You agree to indemnify and hold WebCallHub harmless from claims arising from your use of the Service, your content, or your violation of these Terms or applicable law.
14. Governing Law
These Terms are governed by the laws of Finland (for customers contracting with HSG IT Services Oy), without regard to conflict-of-law rules, and disputes will be resolved in the competent courts of Helsinki, Finland. Nothing in these Terms removes any mandatory protection available to you under the laws of India.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced by email or dashboard notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
